SPONSORING ORGANIZATION: The name of this sweepstakes is Trailborn Grand Canyon Giveaway (“Sweepstake”), and is sponsored by Trailborn Hotels(“Sponsor”). Sponsor is a company with its principal place of business at 420 W. 14th Street, Suite 6SE, New York, NY 10014.

DESCRIPTION: Individuals who fill-out the entry form or submit an Alternative Entry pursuant to the process below will automatically be entered into a drawing for a chance to win a prize.

SWEEPSTAKES PERIOD: Individuals meeting the eligibility requirements set forth below may enter the Sweepstakes between 12:01 a.m. (EST) and 11:59 p.m. (EST) on February 20-21 2025 (“Sweepstakes Period”).

ELIGIBILITY: By participating, entrants agree to be bound by these official rules (“Official Rules”) and the decisions of the Sponsor. Entries received after the expiration of the Sweepstakes period are not eligible to win.

To be eligible to win entrant:
1. Must be at least eighteen (18) years of age at the time of registration; and

2. Must be a resident of the United States of America at the time of entering the sweepstakes by participating in the Event or through the Alternative Entry process detailed below.

*Paid employees of Sponsor or Sponsor vendors/suppliers and their immediate family members (spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children, and grandchildren) are not eligible to win.

HOW TO ENTER: No purchase (or donation) is necessary to enter or win the Sweepstakes. A purchase or donation will not increase your odds of winning.

Entrant may enter the sweepstakes by:

1. Participating in the Event; or
2. Submitting entrant’s full name, address, phone number, and email address to TGC Giveaway ℅ Trailborn, 420 W. 14th Street Suite 6SE, New York, NY 10014 (“Alternative Entries”).

All entries must be received by the Sponsor prior to the expiration of the Sweepstakes Period.

PRIZES AND ODDS OF WINNING: Under these Official Rules, the Sponsor shall award prizes (as specified in the Giveaway) to 3 individuals (“Prize”). The approximate retail value of the Grand Prize fluctuates from $200 – $700. The approximate retail value of the Two Runner Up Prizes is $80 – $150.

Prizes shall be awarded through a random drawing from the entries Sponsor receives during the Sweepstakes Period. The odds of winning depend on the number of eligible entries received. The decision of the Sponsor regarding the selection of winners shall be binding. Winners may not substitute, transfer, or assign Prizes. No Prize can be redeemed for cash or replaced if lost or stolen. Sponsor reserves the right to replace and/or substitute a like prize of equal value, should the specified Prize be unavailable for any reason.

SPONSOR MAKES NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS SWEEPSTAKE OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING THE PRIZE OR ANY COMPONENT OF THE PRIZE.

WINNER NOTIFICATION: The Prize drawing shall be conducted on the date specified by the Giveaway and winners will be notified by phone, email, or mail. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected from among all remaining eligible entries. If a potential winner cannot be contacted or does not respond to Sponsor within seven (7) calendar days from the date Sponsor first tries to notify winner, such potential winner forfeits all rights to win the Sweepstakes or receive the Prize, and an alternate winner may be selected from all remaining eligible entries.

Sponsor is not responsible for late or misdirected Prize shipments and Sponsor reserves the right in its sole discretion to determine remedies, if any, to Prize fulfillment issues.

PARTICIPATION: By entering into the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor which shall be final and binding in all matters relating to this Sweepstakes.

This Sweepstakes is void where prohibited by law. Sponsor does not warrant that the Sweepstakes is valid in any particular state or jurisdiction. All applicable federal, state, and local laws and regulations shall apply.

Except where legally prohibited, each winner grants (and agrees to confirm the grant in writing if requested) permission for Sponsor, its advertising and promotion agencies, and those acting under their authority to use his/her name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes without additional compensation.

Submission of contact information in connection with this Sweepstakes (whether or not required), including mailing address, phone number, and/or email address, during entry constitutes permission for Sponsor to add the entrant to Sponsor’s customer database and to contact entrant in the future for promotional and other reasons. Entrant may opt-out of receiving such communications as outlined in Sponsor’s Privacy Policy (available upon request) as provided within any such marketing materials (e.g., using the unsubscribe feature provided in the footer of Sponsor’s emails).

WINNERS’ RESPONSIBILITY FOR TAXES: Winners are solely responsible for any and all applicable federal, state, and local taxes. If applicable, all winners should expect to receive a tax form 1099 for the value of the Prize as provided by current tax laws.

SPONSOR’S RIGHT TO SUSPEND OR TERMINATE SWEEPSTAKES AND MODIFY OFFICIAL RULES: In the event the Sweepstakes is compromised in any way which corrupts or impairs the administration or fairness of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to suspend or terminate the Sweepstakes at any time. Such events may include, but are not limited to, computer viruses or a security breach. Should the Sweepstakes be suspended or terminated prior to the expiration of the Sweepstakes Period, Sponsor reserves the right to award Prizes based on eligible entries received prior to the termination date. Sponsor reserves the right to amend these Official Rules at any time.

ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

LIMITATION OF LIABILITY: Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Sponsor and its respective affiliates, officers, directors, employees and agents do not have and will not have any liability whatsoever for, and shall be held harmless against any liability for any injuries, losses or damages of any kind to persons, or property resulting in or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize or participation in this Sweepstakes or any Sweepstakes-related activity; or for any typographical or other error in the printing, offering or announcement of any Prize. Should a court of law find Sponsor liable for loss or damage, Sponsor’s liability will be limited to the cost of entering and participating in the Contest, and in no event shall Sponsor be liable for attorney’s fees.

Sponsor and its affiliates, officers, directors, employees, and agents will have no liability whatsoever for entries that are late, incomplete, or not received for any reason

GOVERNING LAW AND JURISDICTION: All issues concerning the construction, validity, interpretation and/or enforceability of these official rules or the rights and obligations of entrants in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of New York without giving any effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. By entering into this Sweepstakes, each entrant consents to have all disputes resolved in the New York City County Courts. Except where prohibited, the entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually, without resorting to any form of class action.
